Living Life [IMG] Tuesday, June 03, 2008 it's that time of the year i feel as if a truck just ran over my head and dumped a whole load of information onto my head. and im just spinning from all of it. gulp. this is the worst exam time table i have ever had. ever. period. some people drink jugs of coffee, im slushing down cartons and cartons of mango and orange juice. i think the sugar keeps me awake. yep. it's that time of the year again peeps. "holding on to the GOOD things in life." 6:27 AM Tuesday, May 20, 2008 of Malam Kenduris and Malam Kenduris gone past A few days ago was Malam Kenduri! It all started with getting a good table, getting the old committe sitting together and it felt very very extremely nostalgic. i feel old. old doesnt even begin to describe the extent of ancientness i felt. all those first years! freaking hell. where did they come from? I'm only gonna post a few pics. hahha. some of them.. eh. cannot make it. and I am very proud to say that this year's committee did manage to pull it off pretty well. MSO has a reputation to protect after all! the satay was magnifique! the satay sauce was to die for. the rest was ok. but i'm happy, 5 bucks a pop and in the confort of my own hall as well :). no complaints from me [IMG ]me , masya, kitty kat, kims, Jay, and Jay-CE in our pyjama party best [IMG ] Face painted XIN! (my fello and trusty gossiper) , me, chubby (the stuffed dog), and diong who won best dressed :) Some of the photos i have yet to get off ppl. But, i started thumbing through old Malam Kenduri Photos and committee photos. Oh man, guys! we had fun. and we were so exhausted at the end of it. but well, if self praise still isnt a crime, i must say, we did a smashing good job as well. but here are some pics from yonks and yonks ago. [IMG ]this was from OUR first year, where we the initiation process of being admitted into MSO was taking place in BnG (who has since been extremely anal and unfriendly towards us- haha). hours of chopping up garlic, eat, chicken wings (ERGHS) Yeps, we MURDERED those chickens! [IMG ] This was some other event when were manipulated into kitchen duties again. done with willing and cheery smiles, hey. [IMG ] we had freaking good gatherings as well. we had hotpots and birthday parties together. we went to floriade together as well (but i cant find the floriade photos). good frienships. haha. i even ended up dating one of them. eh. he seems to be skinnier in this pic then he is now. STUDY FROM DAY ONE HONG YIN! well, i dont really think i have slacked off. It's just that, assignments consume me. I have OCD and I spend hours and days slaving over my assignments. why oh why can i not complete an assignment in a shorter period of time. If only I had another 2 weeks grace. "holding on to the GOOD things in life." 5:46 PM Friday, May 09, 2008 Sydney! haha. i think every single year, i have a few posts that go Sdyney and invariably they have an exclamation mark and many photos posted up. but yes, once again, Sydney was a city that saved my sanity. I've just been so bogged down with assignments that I feel as if ANU and Civic and well, more precisely, my room has been the constricting cage that I've been in. and it felt so good to walk down a busy street breathing in the horribly polluted air while watching a ton of cars and buses squeezing into lanes up and down the roads. i heart you Sydney. very very much indeed. this time. i guess, it was old haunts again. trips to yum cha, birkenhead point, fish market etc etc etc. but it was with a bunch of new peeps this time and it was very very good. so what was new was, well. haahaha. i went to the David jones on Elizabeth Street. and goodness gracious me. i think, :D life is good. a few of my dreams came true that day. well. partially true anyways. i slipped on a pair of Manolos. JImmy Choos. Kate Spade. Burberry. Marc Jacobs. Christian Louboutin. even an extremely tacky pair of Juicy Couture shoes. and i have photos of the MOnolos as well. so, the million dollar, well the AUD 1540 question is, are they truly as SEXY and and yet comfortable as rumoured? well, oh yes baby, they are and much much more. its like having all this elevated power, that makes you want to walk with a confident strut and yet, they are so comfortable, even I, with my sprained ankle felt like i was walking on cloud 9. BIG BIG SMILE. i guess, the older i get the more i realise how superficial and vain and what a capitalist soul i have. and to be honest, i am not ashamed to admit it. hell, id even shout it from the rooftop of my (future) multi million dollar penthouse if you asked me to. one of my friends just won $600,000 in a lotto. i am happy for him. he is very very blessed. but i must say i would be ten times, and have 600 000 reasons to be happier if that winner were me instead. the first thing i thought of when i went virtual shopping in my mind was, omg, i can finally get that vuitton bag ive always wanted. life is short, and one day, i want to be able to look at my knocked down pair of nine wests and pass them on to my maid. but as of now, i cant keep those shoes of my feet! hong yin wants to be filthy rich. mmmmmmmmmmmmmmmm. Id like to redeem myself by, well, explaining why I did such a terrible deed. I was in the National Library and I was doing dome research and i tried saving it in my pendrive, which wasnt there- i tried printing it-eeks, i needed money- and, they barred all entry to e mails. Hence, since i could log into my blogspot account, there we are. Knowledge for everyone! please dont try reading or understanding it, because it is just pieces and fragments of disjointed information which i shall attempt to piece together soon! very soon. sigh I had to wade through lectre recordings for law today. and i was SO FREAKING BORED. so i procastinated. I baked cheese cup cakes (which are all gone now - in case you were going to ask- hehee. some are reserved!), I went on facebook and added people! kepoh-ed around. realised that some people are ATTACHED EDI! zomgs. haha. well, i kinda knew before, but now facebook has made it OFFICIAL. sigh. i never used to be addicted to Friendster, but Facebook, baby, its a whole different ball game! And, i also went blog surfing!! read up on the latest goss! And i re-realised why i dont blog anymore. or so often anyways. Blogs, facebook- stuff fthat you write on your personal site, your feelings, how you spent your day. they just reveal so much of you, more than you think you are giving away. and i find myself judging people based on what they write- even based on the lil captions they put up on pictures. and i know heaps of other people do as well! *note to self- must not be judgmental* but i swear! some people are so self centered, some are so BIMBOTIC, but some are very very impressive and cool and makes the reader want to know the person more and more! yah. but some ppl are just so.. haihs. *shall stop judging* hehehe. so yes. this is my grand return to the blogging world. bwah. judging by the frequent and failed attempts to restart my flagging blog, dont keep your hopes up! btw. best news for the MONTH!- WILL is coming back to canbo in Jine for a YEAR. to do his Masters. "holding on to the GOOD things in life." 4:47 AM Friday, March 07, 2008 In his ‘Dialogue on Private Property’,1 Felix Cohen According to Cohen,2 private property must at least involve the right of the owner to exclude others from doing something in respect of the object of ownership: there is such as thing as non-saleable property falls into the trap of supposing the term ‘property’ to connote the thing which is the object of ‘ownership’. But the beginning of truth about property is the realization that property is not a thing but rather a relationship which one has with a thing To claim ‘property’ in a resource is, in effect, to assert a strategically important degree of control over that resource; there may well be gradations of ‘property’ in a resource. Suppose that, instead of inviting you to dinner in our home, we installed you as a lodger in one of the attic bedroom. Or even imagine that during our dinner party we agreed to sell you the entire house and have since transferred the registered title to you … The common law world has never really resolved whether property in land is to be understood in terms of empirical facts, artificially defined rights, or duty-laden allocations of social utility. Although these three perspectives sometimes interact and overlap, it remains ultimately unclear whether the substance of property resides in the raw data of human conduct or in essentially positive claims of abstract entitlement or in the socially directed control of land use. In short, the idea of property in land oscillates ambivalently between the behavioural, the conceptual, and the obligational, between competing models of property as a fact, property as a right, and property as a responsibility … 1.8 In the Aboriginal land rights case Milirrpum v Nabalco (1971) 17 FLR 141 at 171 Blackburn J summed up the legal meaning of property as follows: I think that property in its many forms, generally implies the right to use or enjoy, the right to exclude others, and the right to alienate. I do not say that all these rights must co-exist before there can be a proprietary interest, or deny that each of them may be subject to qualifications. It follows that it is possible to say I have a full property right in my car. it is nonetheless possible for property to exist where one or other of these features is missing as the following examples demonstrate 1.9 The right to use or enjoy In Yanner v Eaton (1999) the term ‘property’ does not necessarily mean full, exclusive or beneficial ownership. ‘property’ does not refer to a thing; it is a description of a legal relationship with a thing. The concept of ‘property’ may be elusive. Usually it is treated as a bundle of rights. It refers to a degree of power that is recognized in law as power prmissibly exercised over the thing … Much of our false thinking about property stems from the residual perception that ‘property’ is itself a thing or resource rather than a legally endorsed concentration of power over things and resources … Wily v St George Partnership Banking Ltd (1999) 84 FCR 423 at 431:it was not necessary that ‘the dominion of the owner be absolute or fixed’. As Jeremy Bentham observed (Theory of Legislation, Kegan Paul ed (1911), p 113): ‘Property and law are born together; take away laws, and property ceases 1.10 The right to alienate As Mason J noted in R v Toohey; Ex parte Meneling Station Pty Ltd (1982) 158 CLR 327 at 342–343: Assignability is not in all circumstances an essential characteristic of a right of property. By statute some forms of property are expressed to be inalienable. There are many examples of non-assignable rights treated as property rights by courts and legislatures. In addition to the frequently encountered non-assignable lease referred to by Cohen in 1.5, in Re Potter (dec’d) [1970] VR 352, for example, a beneficiary under a will was held to have acquired a non-assignable right to reside in a certain house as long as he desired. This right was clearly regarded by Menhennitt J as proprietary in character. It has also been held that the so-called ‘statutory tenancy’ of a tenant whose lease has expired, but who remains in possession pursuant to legislation controlling rents and security of tenure, has a non-assignable interest in the land.4 Also, in New South Wales, ‘community land’ held by local councils for the community benefit, is declared by statute to be inalienable.5 -- 1.11 The right to exclude Because property typically entails a right to exclude others, it is an essentially private right exercisable against the general public, including the state. It therefore makes little sense to talk about rights that all citizens, as citizens, jointly enjoy over things as property rights. An example of such a right is the common law public right to fish and navigate in the open sea.6 This right extends to tidal waters.7 These rights were brought to Australia on settlement, and continue to apply, unless modified by statute.8 Public rights are to be distinguished from public ownership of utilities or industries. It does not embrace interests in which the person concerned has no greater claim than any other member of the public. All members of the public have a right to pass freely along or across public highways but none have in their capacity as members of the public any estate or interest in the land. Since the Minister had the power to approve or disapprove. What kind of right is that? S conferred right????? In granting licenses to fish- is that not excluding some ??? Three separate mischiefs are targeted by this restrictive approach to the creation of novel interests in land. The first of these is the concern to maximise the uses to which land can be used. The fragmentation of property rights into smaller, discrete bundles capable of individual ownership was an essential element for the commodification of land, and, in consequence, for the introduction of economically efficient uses of land.- burgeoning market-oriented economic order in the middle of the 19th Century in England. A second policy evident in dicta in these cases addresses the vice of adding to the already existing difficulties that confront third parties who purchase the land. The third policy is that of protecting the integrity of what Lord Brougham refers to as ‘the science of the law’. This phrase refers to the process of systematisation and rationalisation of the common law that was a dominant concern in 19th Century English legal culture. If property owners were able to create at whim any kind of property right, the process of measured categorisation of interests by judges, legislators and commentators — the foremost practitioners of ‘legal science’ — would be frustrated. Property rights and the rights of persons 1.34 As Mosk J argues in Moore’s case below (1.37C), this reflects the fact that ‘our society acknowledges a profound ethical imperative to respect the human body as the physical and temporal expression of the unique human persona’. In an extreme form this has meant that persons have become ‘objects’ of property rights, akin to ‘things’, or chattels, in law. Societies based on slavery are typically of this order. More commonly, marginalised groups have been denied rights to own property. Such groups have included Jews in England,31 slaves in parts of America32 and married women in England and Australia33 until the enactment of married women’s property legislation in the late nineteenth century The definition of personal rights includes the rights that a person has over his or her own body. Among personal rights we normally include rights to protect and safeguard the body, most obviously protected by the torts of assault and battery. Furthermore, aspects of personality are protected, such as one’s reputation, by the tort of defamation, and more recently by legislation protecting the privacy of individuals. But the dividing line between personal rights and property rights is not always easy to draw. For instance, is one’s reputation property which can be commercially exploited by affording property rights to it? Is the right to pursue a profession, a right of demonstrable economic and social value, a property right? The question of the proprietary character of personal rights is particularly relevant in the case of rights over human tissue, organs and other body parts. This section will examine aspects of property law and the body. Margaret Davies and Ngaire Naffine, Are Persons Property? Legal Debates about Property and Personality Ashgate, UK, 2001, 1–3 [footnotes omitted] For the short answer is that we do not recognise slavery; one person cannot own another. It is regarded as an abomination to commodify another human being in this manner. The Western democracies outlawed slavery in the nineteenth century, though as Russell Scott has observed, it has ‘not all disappeared from the Eastern world, nor from the African and South American continents’. As Rosemary Owens explains, ‘In the famous Sommersett’s Case [of 1772], English law decided against slavery, proclaiming its allegiance to the Enlightenment person and promising a protection for freedom’. In Sommersett’s Case, it was concluded that there was no ‘positive, or legislative, authorisation of slavery in England’. It could therefore be said with some confidence that Anglo-Australian law is in accord with the views of two of the leading philosophers of political and legal liberty, John Locke and Immanuel Kant, who, in different ways, both condemned the idea of treating other persons as property. According to Kant, ‘a person cannot be property and so cannot be a thing which can be owned, for it is impossible to be a person and a thing, the proprietor and the property’. Locke, too, was adamant about the importance of freedom from possession by others. In The Second Treatise on Government Locke begins his discourse on slavery by saying that ‘The Natural Liberty of Man is to be free from any Superior Power on Earth, and not to be under the Will … of Man … not to be subject to the inconstant, uncertain, unknown, Arbitrary Will of another man’. He goes on to say that This Freedom from Absolute, Arbitrary Power, is so necessary to, and closely joyned with a Man’s Preservation, that he cannot part with it, but by what forfeits his Preservation and Life together. For a Man, not having the Power of his own Life, cannot, by Compact or his own Consent, enslave himself to anyone … No body can give more Power than he has himself; and he that cannot take away his own Life, cannot give another power over it. According to modern legal orthodoxy, Locke, Kant and modern law are ad idem in that the categories of person and property are now meant to be utterly separate and distinct. To be a person, it is said, is precisely not to be property. Thus it might be argued that the one concept negatively defines the other … Panelli J suggested that questions relating to property in cells should be resolved by legislatures, rather than courts. By contrast, Mosk J argued that courts should be prepared to extend the common law to resolve the moral issues presented by the development of biotechnology. What are the advantages and disadvantages of relying on legislation to create new forms of property? There is no right of property in a dead body (Haynes Case (1614) Co Rep 113),unless it has undergone some process or application of human skill such as stuffing or embalming: Doodeward v Spence (1908) 6 CLR 406.38 In Doodeward, the appellant purchased for the purposes of public display the preserved foetus of a two-headed child, still-born some 40 years previously. Police confiscated the item, and the appellant brought an action in detinue (see 2.6) to recover it ‘when a person has by the lawful exercise of work or skill so dealt with a human body or part of a human body in his lawful possession that it has acquired some attributes differentiating it from a mere human corpse awaiting burial, he acquires a right to possession of it …’. In R v Kelly [1998] 3 All ER 741 the English Court of Appeal found that body parts unlawfully removed from the custody of the Royal College of Surgeons came within the meaning of ‘property’ in s 4 of the Theft Act 1968 (UK). The removal and preservation of these parts was achieved ‘by virtue of the application of skill, such as dissection or preservation techniques, for exhibition or teaching purposes’ (per Rose LJ at 749–750). Rose LJ added (at 750) that ‘the common law does not stand still. It may be that if, on some future occasion, the question arises the courts will hold that human body parts are capable of being property for the purposes of s 4, even without the acquisition of different attributes, if they have a use or significance beyond their mere existence. This may be so if, for example, they are intended for use in an organ transplant operation, for the extraction of DNA or, for that matter, as an exhibit in a trial’ (emphasis added). I think ive gotta start making myself feel anxious and hope a tidal wave of anxiety sweeps over me. i find i study best under stress. Its a great motivator. Well.... .... .... crap. no anxiety, looks like it Im gonna be buildng railway lines in Russia in the next hour or so. Plus. if any of you guys are reading this. Well,just to let you know. "holding on to the GOOD things in life." 9:01 PM Monday, October 22, 2007 Booking plane tickets Im staying back in Canberra for a couple of weeks after my exams. Cause my bro is hving his SPM and my mom does not wnat me to distract him. I wonder what that syas about me at home. but anyways. I tried to change my ticket which was initially booked for the 18th of NOv to the 30th of Nov or the 1st of Dec. SIGH. I was on hold for half an hour with MAS. Only to realise that I have to call Austrian Airlines because of some administrative difficulties. I called Austrian, and did not have to hold on the line at all. Man, does the 'Malaysian-ness' bug in answering phones slowly and being inefficient spread overseas? Even the Ang mohs in the Sydney MAS Office have contracted the Malaysian bug. couple that with long lunch breaks and hang overs in the morning, and well... you get very dissatisfied customers. Austrian Airlines. To make changes to bookings, I had to scan my ticket and e mail it to them. I did so, gave them my contact details, and preferential flight dates. I asked for the 30th of Nov. They gave me the 9th of DECEMBER. without calling or contacting me, they just booked me into a flight which I did not want at all. What the hell is the point of asking for my contact details if you arent going to contact me if my preferential dates are not available. It also took them the whole of Friday and Monday morning to process my request. When I called earlier, MAS had the dates which i requested. DAMN. Hence, I called them up. Was a tad bit sarcastic, and now Im booked for the 28th of Nov. instead of just calling me and getting me a flight a couple of days before the date i requested, the gave me a date a well plus after the one i requested. WITHOUT CALLING me to CONFIRM. BAH. ok blogged it all out now i can go back to my law recordings. The good news that i received today has temporarily blocked out the fact that if the holidays are near, it means that exams ARE EVEN NEARER. DAMMIT. But let me not dwell on that sad and rather frightening thought. Holiday plans. 1. applying for an internship in Malaysia. there is this law firm whihch i would LOVE to work in, but i do not know if it will work out. cross my my fingers! 2. go to singapore to visit Will again. before he leaves for TEXAS! let me rant about what a silly and stupid place Texas Uni is in another post. wait. no. i shall do it here. Its ranking is not as high as ANU. And dangerous fauna and flora exist everywhere. CACTUSES with prickly prickly thorns. RATTLE Sankes with lethal venom in their fangs. scorching heat with a much higher chance of contracting skin cancer. Fast food and more fast food. sigh. Honestly. SIGH. 3. Go to Thailand and Canbodia. YAY! ok. initially when Mel proposed that we go, what immediately sprng to my mind was a decent hotel, walking distance to the beach, shopping and shopping and SHOPPING and essentially having a nice relaxing holiday. BUT THEN, sigh, i was delusional. Apparently, its going to be a backpacking and jungle treking experience. REWIND. sigh. somehow, all my thoughts of having a relaxing massage isnt going to materialise. note to self. must revamp expectations. Sigh 4. SLEEP and shop. apparently, midvalley has a new wing. A massive massive wonderful wing! i wonder what hidden goods are awaiting for me to pick them up and purchase them. But then again, I must say that i LOVe LOVE Aussie clothes. very fun and funky! and a huge and much better variety. Malaysian clothes are smaller, tighter, shorter and limted!
