Let's follow this logic for a moment by using another example, say Tom Cruise.

American Apparel's defense is that they can use Tom Cruise's image without his permission, and if they get sued by Cruise, they can say, 'Well, Tommyboy jumped on Oprah's couch and believes he is covered with alien body thetans' and fronts a kooky religion" therefore he is "fairgame" (pun intended) for using his image without permission or compensation. Therefore any lawsuit Cruise brings against them would be null and void because Cruise's reputation is jacked and he's a well-known nutjob.

This doesn't seem fair or legal, even to us.

AND Slotnick says "The company MAY be open to avoiding a trial?"  REALLY? Perhaps the real truth here Slotnick, is that your defense will be shot down in flames? And maybe, just maybe, your clients American Apparel don't want to make total asses out of themselves (again) and want to "set an example for the fashion industry."  

For such a HUGE wealthy company, who is obvioulsy guilty of copyright infringement....$10 million dollars seems like a slap on the wrist for American Apparel to me. I will be waiting with popcorn to see how this one unfolds.

Hey American Apparel - pay Mr. Allen what's rightfully due, and go slink back under your rock, along with your trashy ass clothes.
