    Cedric Benson of Chicago Bears Arrested for Boating While Intoxicated on Lake Travis in Austin, TX Here is an excerpt from the Chicago Tribune story on his arrest and claims of police abuse: Cedric Benson fully intends to fight misdemeanor charges of boating while intoxicated and resisting arrest stemming from a Saturday night incident near Austin, Texas, during which police used pepper spray to detain him. Lower Colorado River Authority police arrested the Bears running back, who played at the University of Texas in Austin, on Lake Travis during a random safety inspection. An LCRA spokesman said Benson, who failed a sobriety "float test" (an abbreviated version of a field sobriety test) on his 37-foot yacht, argued over taking a follow-up test on land and refused to put on a life jacket. LCRA officers said they attempted to arrest Benson at that time but that he refused to cooperate and was pepper-sprayed. He was booked at 11:24 p.m. Saturday at the Travis County Jail and was out early Sunday morning on $14,500 bond. Benson denied the charges. "There was no resistance on my part," Benson told the Tribune on Sunday night. "Was I drunk? No." Benson said there was alcohol on his boat but that he was not intoxicated and the boat was stationary when police arrived. He said he fully cooperated with officers and that this was the sixth time he had been questioned by lake police in the year that he has owned the boat. "They gave me a field sobriety test, told me to say my ABCs and told me to count from 1 to 4 up and down," Benson said of Saturday's incident. "I'm thinking, I passed all the tests, did everything right. Then the officer told me we needed to go to land to take more tests. I politely asked him why we needed to go to land to take more tests when I took every test. Then he sprayed me with mace, on his boat. "I'm not handcuffed. I'm not under arrest. I'm not threatening him. I'm not pushing him. I'm not touching him. And he sprays me right in my eye." Benson said by that time, he was far removed from the family and friends left on his boat, a group that included his mother. "Nobody saw what he did to me," Benson said. "I started screaming for my mother to come. That's when they put me under arrest. And the officer threw a life jacket over my head. "Once we got to land, the Travis County police grabbed me and kicked my feet from under me. So I landed on my back while I was handcuffed. They held me down and held the water hose over my face. I couldn't breathe, I'm choking, I'm begging the cops, 'Please stop. Please stop.' Then they picked me up and dragged me backward toward their car. And I'm still being polite, asking them, 'Sir, could you please allow me to walk like a man to your cop car?' They just kept dragging me on." The charges are punishable up to six months in jail and $2,000 each. No court date has been set. The BWI charge carries the same weight as a DWI in Texas. Benson's lawyer, Brian Carney, said he believes the police were unjust in dealing with Benson. "Right now it's one-sided, and I would like to know exactly what they're basing their allegations on," Carney said. "It's very, very early. And we still haven't had a chance to evaluate what exactly they think that they have. "Those allegations are untrue. I think it's a shame that they proceeded the way they did. I can tell you right now that we're going to resolve this. We're going to work through it. And we're going to maintain our position that this was inappropriate and that he's not guilty of any of these things. Cedric was extremely cooperative with these officers. He complied. He performed their tests that they asked him to do."     This will be an unpopular opinion to some but that's why I have this blog, to convey my thoughts and allow my writers to do the same.  Expect a lot of coverage of the Cedric Benson arrest on the site because NHBS has learned that Cedric Benson's account of what happened on Lake Travis this weekend is more accurate then what the police department report has stated. For a summary, here are the 2 versions of the story, 1st as told by Lower Colorado River Authority (LCRA) courtesy of the Chicago Sun -Times  Benson tells a very different story of how the arrest went down as he explains here to the Chicago Tribune NHBS has been told that the truth lies somewhere in the middle here but that the LCRA certainly used excessive force Today it was disclosed to the Tribune that a friend of Cedric Benson's is confirming what we at NHBS have been told and there may be photo evidence to support that claim as well as testimony from others on the boat. We will update this story throughout the day.

    Filed under: Bears, NFC North, Chicago, NFL Police Blotter According to the police officers who arrested him for boating while intoxicated, Cedric Benson was argumentative and threatening which led them to pepper spray him and add resisting arrest to his rap sheet. Benson is being disagreeable with the police, all right, and says that all the charges against him are completely bogus. He said that while there was alcohol on the boat, he wasn’t intoxicated and felt that he passed the field sobriety test administered on the boat. He claimed he wasn’t argumentative, just questioning, when police said he needed to return to land for more tests and, when they did get to land, the police escalated things. “Once we got to land, the Travis County police grabbed me and kicked my feet from under me. So I landed on my back while I was handcuffed. They held me down and held the water hose over my face. I couldn’t breathe, I’m choking, I’m begging the cops, ‘Please stop. Please stop.’ Then they picked me up and dragged me backward toward their car. And I’m still being polite, asking them, ‘Sir, could you please allow me to walk like a man to your cop car?’ They just kept dragging me on.” Benson also claims he’s a target for police looking for a big name, since he’s been questioned by authorities six times in the year he’s owned the boat. Bears coach Lovie Smith said he was “disappointed” but would wait for more information before acting. Any action from the team would presumably be later in coming as well. The Bears famously parted ways with Tank Johnson after an arrest but that was after several indiscretions. Benson had some legal issues while in college but has confined his screwups to the field since coming to Chicago. The NFL has a very liberal sliding scale when it comes to off-field trouble, the reason why Johnson got so many chances. Look no further than the way the Pittsburgh Steelers handled two domestic violence cases this year. Cedrick Wilson, a backup wideout, was cut immediately while All-Pro linebacker James Harrison will be wearing a Steeler uniform this season. Benson is somewhere between those two players but the Bears need reasons to keep Benson, not more ammunition for cutting him loose. &&&& Share This

    Dumbass of the Week Nominees

    Plenty of candidates for this week's award coming from all areas of the sporting world. From college hoops and Indiana Center Eli Holman's temper-tantrum to soccer star Fat Ronaldo having a run in with some transvestite hookers in Brazil, all the way back to Chicago Bears Running Back Cedric (My Favorite last name in football) Benson boating down the Colorado River drunk and failing a Field Float Test, yes that is an actual test as described by Colorado law. Nominee #1: Eli Holman, Freshman, Center, Indiana University Basketball. When IU hired Coach Tom Crean he immediately knew he would have to be crafty to field a team next year due to player removal, graduation and early-entry to the NBA by Eric Gordon. He didn't know he would need to be crafty to avoid flying objects hurled in the basketball office by disgruntled freshman centers. Expressing his plans to explore one more transfer possibility, Holman was enraged when Crean told him something he didn't want to hear. Apparently Big Eli doesn't like to be told no because his immediate reaction was to throw an elementary school like temper-tantrum and hurl objects through the basketball office. He was just crazy enough for Crean and the IU staff to call the University Police Department, thankfully no charges were filed but good luck transferring Eli. Nominee #2: Ronaldo, Striker, AC Milan. First of all it is worth pointing out that prostitution is legal in Brazil so Ronaldo is not being targeted as previous winner Chris Henry as someone that broke the law. Unfortunately being on the right side of the law did not enable the large-boned striker's ability to maintain on the right side of his sexuality. These actions just leaves NHBS with one question for Ronaldo, did you notice the atom's apple? Nominee #3: Cedric Benson, Running Back, Chicago Bears. The much maligned Benson certainly could not have been happy about the Bears drafting Tulane Sensation Matt Forté in the 2nd round of the draft last weekend so naturally he got drunk. Apparently no one told Cedric that just like a car, it is illegal to operate a boat while under the influence. Benson was arrested Saturday for what we like to call in Bloomington, a BUI, not to be confused with the always valuable nautical device a buoy. Oh Cedric, if you hadn't already lost your job to the rookie Forté, surely now you have. Winner announced tomorrow.

    First were the questions about marijuana use. Then, there was the questioned ability to be a good teammate. Soon after, there was the sluggish running. Now, there is this. Per Chicagosports.com, Cedric Benson was arrested late Saturday night near Austin, Texas and charged with boating while intoxicated and resisting arrest, both Class B misdemeanors. Benson failed a sobriety “float test” – an abbreviated version of a field sobriety test – and then proceeded to argue with Lower Colorado River Authority officials over taking a second test on land and putting on a life jacket. When LCRA officials attempted to make an arrest, Benson refused to cooperate and consequently, was pepper sprayed. Benson was booked at 11:24 p.m. and is out after posting $14,500 bond. Timing couldn’t be worse for the embattled Benson. He’s been a huge disappointment after being selected fourth-overall in the 2005 NFL Draft. In three seasons with the Bears, he has rushed for totals of 272, 647 and 674 yards. Last year — his first as a full-time starter — he averaged only 3.4 yards-per-carry. The Bears drafted Tulane running back Matt Forte in the second round of this year’s Draft in hopes of pushing Benson. Now it looks like it will be Forte’s job to lose. Benson is currently recovering from a broken leg suffered last season. Add that to his lack of production and off-the-field troubles and it should mean the end of his era. And what an era it was! GM Jerry Angelo has already called Forte a “three-down back” meaning he can carry the load.
