The Browns point to the growing acceptance of gay and lesbian relationships by the legal system as another reason to accept their multiple marriage between consensual adults, and state that, in their estimate, there are over 30,000 polygamists currently living in Utah.
Attorney Turley said “We believe that this case represents the strongest factual and legal basis for a challenge to the criminalization of polygamy ever filed in the federal courts.” Turley says they are not necessarily seeking State legitimization of the Brown’s multiple marriage, but instead are “challenging the right of the state to prosecute people for their private relations and demanding equal treatment with other citizens in living their lives according to their beliefs.”
